Toward the end of 2008, the Flagstaff Municipal Court began forfeiting cash bonds that were posted on Failure to Pay charges. The Court presumably discovered that people would post a cash bond to get out of jail and instead of paying for their fines once released, they would NOT pay and subsequently get rearrested again and again for the same offense. Only those cash bonds that pertain to Failure to Pay charges are affected and only for those cases later than 2008. Cases older than 2008 may have their bond forfeited if the defendant has a bad payment history.
